Superior Court, 111 Wash. 187. 189 Pac. 1016 (1920).<\/strong><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff4500;\">Facts<\/span><\/strong><\/p>\n<p><span style=\"color: #000000;\">Plaintiff filed suit for personal injuries against Defendant who, at all times material to, was a resident of the state of Nevada.\u00a0 The case went to trial in King County and the defendant was present.\u00a0 When the case was called to start, Plaintiff dismissed her suit, and before Defendant could leave the courthouse, a complaint was served on her in an action seeking damages upon the same facts alleged in the original case just dismissed.\u00a0 The Defendant entered a special notice of appearance and asked the court to quash the attempted service of the complaint for the reason that she was privileged from service for the reason she was within the state at the time of the alleged service as a party in an action then pending in the court, and there solely to defend herself in that action.\u00a0\u00a0\u00a0<\/span><\/p>\n<p><span style=\"color: #ff4500;\"><strong>Judicial History<\/strong><\/span><br \/>\n<span style=\"color: #000000;\">Motion to quash was denied and the matter was appealed.\u00a0<\/span><\/p>\n<p><span style=\"color: #ff4500;\"><strong>Specific Issue<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Can a nonresident litigant, who comes to this state solely to defend a suit in which he is named a party, be served with process in a new suit while temporarily within this state?\u00a0\u00a0<strong>No\u00a0\u00a0\u00a0<\/strong><\/span><\/p>\n<p><span style=\"color: #ff4500;\"><strong>Holding<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">A nonresident of the state is privileged from the service of process in a new suit while he is temporarily in the state defending a suit then pending.\u00a0<\/span><\/p>\n<p><span style=\"color: #ff4500;\"><strong>Reasoning<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">This rule was primarily adopted for the purpose of preventing inconvenience to the courts and to facilitate the orderly and unhampered trial of causes.\u00a0 This was the first time this question was presented to the court, although it had been before the Federal courts and the courts of a majority of the states.\u00a0 The rule has been modified to allow the exemption only if service of process interferes with the judicial proceeding then pending, see\u00a0<a style=\"color: #000000;\" href=\"http:\/\/www.c4pse.com\/\">Anderson v.
