Facts and Judicial History<\/strong><\/b><\/span><\/p>\n

Stikes Woods Neighborhood Association appealed the city of Lacey\u2019s land use determination of nonsignificance at a city council meeting. \u00a0The City Council upheld the determination. \u00a0On a Monday, and 32 days later, Stikes Woods applied for a writ of review in Thurston County Superior Court. \u00a0Under Revised Code of Washington, Stikes Woods had 30 days to appeal the City\u2019s decision. \u00a0The 30th day fell on a Saturday.\u00a0<\/span><\/p>\n

City moved to strike Stikes Woods\u2019 application for the writ, arguing that the writ was untimely. \u00a0Superior Court denied City\u2019s motion. \u00a0City filed a motion for reconsideration of the court\u2019s ruling. \u00a0Superior Court granted its motion, finding that the 30 day limitations period had run on Stikes Woods\u2019 application.\u00a0<\/span><\/p>\n

Superior Court quashed the writ of review and the Supreme Court accepted review of this matter. \u00a0The matter was reversed and remanded for hearing on the merits.<\/span><\/p>\n

    Once plaintiffs are in Superior Court,\u00a0CR 6(a)<\/a>\u00a0supersedes Washington State\u2019s\u00a0RCW 1.12.040<\/a>. \u00a0Final Saturdays are to be excluded when computing statutes of limitations periods.<\/span><\/p>\n

    C4PSE Comment<\/strong><\/b><\/span><\/p>\n

    This case establishes that the last day of a statute of limitations cannot fall on a Saturday or, by inference, on a Sunday or holiday but must occur on a court day.
