Certain statutes contain wording which requires that a mailing take place after another aspect of the service has been completed. These fall into three major categories: landlord – tenant, garnishments, and service under RCW 4.28.080(17) which is an alternative form of service allowed at a place where the servee’s mail is received.<\/span> Tell me more.<\/b><\/span><\/p>\n

There are certain over reaching requirements common to all.<\/span><\/p>\n

Postage<\/strong><\/u><\/span><\/p>\n

In all cases the postage must be prepaid in an amount adequate to assure proper delivery by the Post Office.<\/span><\/p>\n

Addressing<\/strong><\/u><\/span><\/p>\n

The envelope must be properly addressed to the last known address of the intended recipient.<\/span><\/p>\n

Point of Deposit<\/strong><\/u><\/span><\/h4>\n

The envelope must be deposited in a US Post Office receptacle. Placing it in the “out going mail basket” does not satisfy this requirement.  Some statutes require the mailing occur from within the county where the servee resides.<\/span><\/p>\n

There are four forms of mail which may be required by various statutes. They are first class, certified, registered, and return receipt.<\/span><\/p>\n

First Class Mail<\/strong><\/u><\/span><\/p>\n

Mail that includes letters and postcards and packages sealed against inspection.<\/span><\/p>\n

Certified Mail<\/u><\/strong><\/span><\/p>\n

First class mail for which proof of delivery is secured but no indemnity value is claimed.<\/span><\/p>\n

Registered Mail<\/strong><\/u><\/span><\/p>\n

Mail recorded in the post office of mailing and at each successive point of transmission and guaranteed special care in delivery.<\/span><\/p>\n

Return Receipt<\/strong><\/u><\/span><\/h4>\n

Return receipt service provides a mailer with evidence of delivery (to whom the mail was delivered and date of delivery), along with information about the recipient’s delivery address.<\/span><\/p>\n

Special care must be taken to insure that any mailing requirement is followed in accordance with statute. Any variance from the procedure specified in statute exposes the entire service to attack.<\/span><\/p>\n
