\nIf against a railroad corporation, to any station, freight, ticket or other agent thereof within this state.<\/em><\/span><\/p>\n

In the past, when railroads were decentralized and less automated, an agent could be found in almost every city and town where the railroad had a station. This is no longer the case. Many stations, especially for railroads moving freight, no longer have agents assigned to them.<\/span><\/p>\n

The structure of these corporations has changed but this statute has not. Fortunately, the statute does allow for service via any “other agent thereof” and railroads, as with most corporations, are required to maintain registered agents so service is generally straight forward by leaving the summons with the person designated as such.<\/span><\/p>\n

Finally, there is a rather interesting distinction in this paragraph of the statute. There is a requirement that the service be presented to an agent of the railroad within this state<\/strong>. The supreme court has enforced this rule to the dismay of a process server who happened to serve the documents across the state line in Idaho.<\/span><\/p>\n
